Welcome to the website (the “Site”) of Boero USA Inc. (“Boero,” “we,” “us,” or “our”). Boero manufactures, markets, distributes and sells high quality industrial paint (the “Services”).
This Privacy Policy describes the Personal Data (defined below) we collect through the Internet, how we use and share that data, and your choices concerning our data practices.
By providing us with your Personal Data through the Internet or accessing the Site, you agree to the practices described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not access the Site or provide us with your Personal Data. Before you access the Site or submit any Personal Data to Boero, please review this Privacy Policy carefully and contact usif you have any questions.
- INFORMATION WE COLLECT
When you contact us or interact with us through the Site or social media, we collect information that alone or in combination with other information could be used to identify you (“Personal Data”) as follows:
Information You Provide: The Site includes a page that allows you to contact us. We will collect the Personal Data you provide through this page, which may include your name, email address, telephone number, and the company where you work.
Information We Collect Through Social Media:We maintain a presence on social media, including LinkedIn. We may collect Personal Data from you when you interact with our social media pages, including your name, user name, and publicly available profile information. In addition, the relevant social media provider may provide us with aggregate information and analysis regarding the use of our social media page. We are not responsible for the privacy practices of the relevant social media services and any information you share with them is subject to their privacy policies and terms of service.
Information We Receive From Your Use of the Site:When you visit, use and interact with the Site, we may receive certain information about your visit, use or interactions. For example, we may monitor the number of people that visit our Site, peak hours of visits, which page(s) are visited on our Site, the domains our visitors come from (e.g., google.com, yahoo.com, etc.), and which browsers people use to access and visit our Site (e.g., Firefox, Microsoft Internet Explorer, etc.), broad geographical information, and Site-navigation pattern. In particular, the following information is created and automatically logged in our systems:

In addition, if at any time you do not wish to receive future marketing communications, please contact us. If you unsubscribe from our marketing lists, you will no longer receive marketing communications but we will continue to contact you regarding our Site and Services and to respond to your requests.
- SHARING AND DISCLOSURE OF INFORMATION
In certain circumstances we may share your Personal Data with third parties without further notice to you, unless required by the law, as set forth below:
Intra-Group: We may share your Personal Data (in particular,your name, email address, telephone number, and the company where you work) with our parent company, Boero Bartolomeo S.p.A., for marketing, relationship management and operational purposes. Boero Bartolomeo S.p.A. will process personal data as a data controller under applicable European Union (“EU”) laws, including the General Data Protection Regulation 2016/679 (or GDPR) and the applicable laws implementing the GDPR in Italy. Personal Data will be processed as necessary for Boero Bartolomeo S.p.A.’s legitimate interest in developing and maintaining a relationship with you and conducting its business and, where required by law, based on your prior consent. You have the right to (i) request access to your Personal Data processed by Boero Bartolomeo S.p.A., (ii) request rectification or erasure of such data, (iii) object to or request restriction of the processing, (iv) request data portability, and (v) withdraw your consent (if applicable). Moreover, if you have a concern about the processing of your Personal Data by Boero Bartolomeo S.p.A., you have the right to report it to the EU data protection authority that is authorized to hear those concerns. You may contact Boero Bartolomeo S.p.A. at sales.boero@boero.it. Personal data may be transferred to countries outside of the European Economic Area that do not offer adequate protection for Personal Data (namely, to the United States); in such case, Boero Bartolomeo S.p.A. will ensure that appropriate safeguards are in place, including using Standard Contractual Clauses for data transfers. Personal data will not be held for longer than necessary with regard to the purposes of the processing, subject to any retention periods provided by applicable laws and regulations. Boero Bartolomeo S.p.A. applies criteria to determine the appropriate periods for retaining Personal Data depending on its purpose, nature, and sensitivity and any retention periods provided by applicable laws and regulations.
Vendors and Service Providers: To assist us in meeting business operations needs and to perform certain services and functions, we may share Personal Data with providers of hosting, messaging, marketing, web development, and sales/customer relationship management services. Pursuant to our instructions, these parties will access, process or store Personal Data in the course of performing their duties to us.
Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider, your Personal Data and other information may be shared in the diligence process with counter parties and others assisting with the transaction, and may be transferred to a successor or affiliate as part of that transaction along with other assets.

The Site and the Services are not directed to children who are under the age of 13. Boero does not knowingly collect Personal Data from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided Personal Data to Boero through the Site or Services pleasecontact usand we will endeavor to delete that information from our databases.
- LINKS TO OTHER WEBSITES
The Site may contain links to other websites not operated or controlled by Boero (“Third Party Sites”). The information that you share with Third Party Sites will be governed by the specific privacy policies and terms of service of the Third Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third Party Sites directly for information on their privacy practices and policies.
- DO NOT TRACK
Our Site currently does not respond to “Do Not Track” (DNT) signals and operates as described in this Privacy Policy whether or not a DNT signal is received. If we do so in the future, we will describe how we do so in this Privacy Policy.
- YOUR CALIFORNIA PRIVACY RIGHTS
California Civil Code Section 1798.83, known as the “Shine The Light” law, gives California residents certain rights regarding Personal Data (if any) that is disclosed to third parties for their direct marketing purposes. While Boero does not share your Personal Data with unaffiliated third parties for direct marketing purposes, it may in some circumstances so share with affiliated entities. To opt out of such sharing, please email Boero at privacy@boerousa.com and clearly state your request, including your name, mailing address, and email address.

You use the Site and Services at your own risk. While we take commercially-reasonable steps to protect Personal Data both online and offline from loss, misuse, unauthorized access, disclosure, alteration, and destruction, no Internet or email transmission is ever fully secure or error free. In particular, email sent to or from Boero may not always be 100% secure. Therefore, you should take special care in deciding what information you send to us via the Site or email.
